Gather Software Group Ltd trading as Digihome is committed to protecting your personal data and respecting your privacy.

This policy together with our end-user licence agreement (EULA) and any additional terms and conditions incorporated by reference into the EULA, together our Terms and Conditions applies to your use of:

> Digihome – Home mobile application software (App) once you have downloaded onto your mobile device (Device)

> Any of the services accessible through the App (Services) that are available on your Device.

This policy sets out the basis on which any personal data we collect from you, or that you provide to us, will be processed by us. Please read the following carefully to understand our practices regarding your personal data and how we will handle it.

This App is not intended for individuals under 13 years of age.

Important information and who we are

Gather Software Group Ltd trading as Digihome is the controller and is responsible for your personal data (“Digihome”, “we”, “us” or “our” in this policy)

You have the right to make a complaint at any time to the Information Commissioner’s Office (ICO) the UK regulator for data protection issues. We are registered with the ICO, reference number ZB047031.

Changes to the privacy policy and your duty to inform us of changes

We keep our privacy policy under regular review.

This version was last updated on 7 June 2022. It may change and if it does, these changes will be posted on this page and, where appropriate, notified to you when you next start the App. The new policy may be displayed on-screen and you may be required to read and accept the changes to continue your use of the App.
It is important that the personal data we hold about you is accurate and current. Please inform us if your personal data changes during our relationship with you.

The data we collect about you

Personal data is any data relating to a person who is identified or who can be identified from the data itself.

You may give us personal data by interacting with the App, by visiting our website, or by corresponding with us.

We may collect, use, store and transfer different kinds of personal data about you as follows:

    • Identity Data: first name, last name, maiden name, username or similar identifier, martial status, title, date of birth, number of dependents, gender.

    • Contact Data: address, email address, and telephone numbers.

    • Financial Data: bank account, card payment details, insurance details including premium information and any other information set out in your insurance policies documents.

    • Device Data: includes the type of mobile device you use the App on, a unique device identifier for example, your Device’s IMEI number, the MAC address of the Device’s wireless network information, mobile network information, your mobile operating system, time zone setting

    • Profile Data: includes your username and password, your photo if uploaded, your interests, preferences, feedback and survey responses

    • Usage Data: includes details of your use of our App including, but not limited to log activity, traffic data and other communication data.

    • Marketing and Communications Data: includes your preferences in receiving marketing from us and our third parties and your communication preferences.

    • Location Data: includes your current location disclosed by GPS technology and/or another technology.

    • Mandatory Data: information we’re obliged to keep for the purposes of the Financial Conduct Authority (FCA) reporting or audit, for example, complaints.

We also collect, use and share Aggregated Data such as statistical or demographic data for any purpose. Aggregated Data could be derived from your personal data but it is not considered personal data in law as this data will not directly or indirectly reveal your identity. For example, we may aggregate your Usage Data to calculate the percentage of users accessing a specific App feature. However, if we combine or connect Aggregated Data with your personal data so that it can or indirectly identify you, we treat the combined data as personal data which will be used in accordance with this privacy policy.

We do not collect any Special Categories of Personal Data about you (this includes details about your race or ethnicity, religious or philosophical beliefs, sex life, sexual orientation, political opinions, trade union membership, information about your health, and genetic and biometric data). Nor do we collect any information about criminal convictions and offences.

How is your personal data collected?

We will collect and process the following data about you:

    • Information you give us. This is information (including Identity, Contact, Financial, Profile, Mandatory, and Marketing and Communications Data) you consent to giving us about you by filling in field and forms on the App or by corresponding with us (for example, by email or in-app chat) It includes information you provide when you download or register the App, subscribe to any of our Services and when you report a problem with an App or any of our Services. If you contact us, we will keep a record of that correspondence.

    • Information we collect about you and your device. Each time you use our App we will automatically collect personal data including Device and Usage Data. We collect this data using cookies and other similar technologies. Please see our cookies policy below for further details.

    • Information we receive from other sources including third parties sources. We will receive personal data about you from various third parties as set out below:
        • Device Data from the following parties:
            • analytics providers such as Apple and Google based outside the UK;

            • search information providers such as Land Registry, DVLA, OpenDataCommunities, Post Office based inside or outside the UK;

            • Contact and Financial Data from providers of technical services based inside or outside the UK.

    • Unique application numbers. When you want to install or uninstall a Service containing a unique application number or when such a Service searches for automatic updates, that number and information about your installation, for example, the type of operating system, may be sent to us.

Cookies

We use cookies and/or other tracking technologies to distinguish you from other users of the App, the distribution platform (App Stores) and to remember your preferences. This helps us to provide you with a good experience when you use the App and also allows us to improve the App.

How we use your personal data

We will only use your personal data when the law allows us to do so. Most commonly we will use your personal data in the following circumstances:

    • where you have consented before the processing

    • where we need to perform a contract we are about to enter or have entered with you

    • where it is necessary for our legitimate interests (or those of a third party) and your interests and fundamental rights do not override those interests.

    • where we need to comply with a legal or regulatory obligation.

We will only send you direct marketing communications by email, text or in-app messaging if we have your consent. You have the right to withdraw that consent at any time by contacting us.

Links to Third Party and Partner websites

Our Apps contain hyperlinks to and from the websites or apps of third parties and partners. Any hyperlinks we provide are there to help you access the services of our partners and are for your reference and convenience, or may be used to understand the action you’ve taken to allow us to improve the service we offer or fulfil offers. When we provide hyperlinks to other websites, we are sometimes paid by the partner or third party. If we are paid when you use the hyperlink on our App to purchase a third party product or service, this is clearly disclosed.

This Privacy Policy only applies to the personal data that we collect or which we receive from third party sources, and we aren’t responsible for personal data about you that is collected and stored by third parties. Third-party websites have their own terms and conditions and privacy policies, and you should read these carefully before you submit any personal data to these websites. We do not accept any responsibility or liability for the content of third-party websites or third-party terms and condition or policies.
